Thousands of Massachusetts drug cases to be dismissed after lab scandal, "ANNIE WAS THE ULTIMATE GRINCH!"

annie dookhan, grinch of all timeBOSTON (Reuters) - Close to 20,000 Massachusetts criminal drug cases are set to be dismissed because of a scandal 
involving a former state chemist who admitted faking tests, civil liberties activists and prosecutors said on Tuesday.
It will mean the largest number of drug cases tossed out in U.S. history due to one person, according to the American 
Civil Liberties Union. Rogue chemist Annie Dookhan pleaded guilty in 2013 to tampering with evidence during her nine 
years working at a state crime lab in Boston. The scandal shook the foundation of the state's criminal justice system.
The Massachusetts Supreme Judicial Court in January ordered prosecutors across the state to dismiss the vast majority of 
convictions tied to that lab, where Dookhan identified evidence as illegal narcotics even without testing it, in an 
effort to make herself seem more efficient.

"Today is a major victory for justice and fairness, and for thousands of people in the commonwealth who were unfairly 
convicted of drug offenses," said Matthew Segal, legal director of the ACLU of Massachusetts, which represented many of 
the defendants during the appeal process.

"The victims of this crisis waited far too long for justice. It shouldn't have taken years of litigation by the ACLU, 
public defenders, and pro bono lawyers to address this stain on the Commonwealth's justice system," Segal said.
Prosecutors in Massachusetts' Suffolk County, which includes Boston, said on Tuesday they had opted to stand by the 
prosecution of just 1.5 percent of the cases they had brought involving Dookhan.

"The average defendant has more than 60 entries on his record," County District Attorney Daniel Conley said, referring to 
the cases his office would still pursue. "They are neither low-level nor non-violent, and they stand at the intersection 
of drugs and violence."

Those cases also rely on evidence not linked to the now-shuttered lab where Dookhan worked, Conley said.

        She should spend the rest of her life in prison.
     
        What happened to the asset forfeitures? I'll be that the State and local governments have not returned them. The 
asset forfeiture policies are absurd. If a person is not found guilty the assets should be returned immediately.       

        My wife takes opioids for chronic pain. She failed back-to-back urine tests according to Quest Diagnostics. They 
said no opioids were in her system but Valium was. I threatened to sue her Doctor because I knew this was incorrect. Two 
months later the Doctors office apologized. Everyone who was tested during that same time-frame had to be retested because 
of an admitted error by Quest.
  
        Everyone should review some older news articles concerning this incident. Before the ACLU stepped in the state 
was going to allow every one of those convictions to stand. They wanted to force people to go to court individually and 
try to fight the convictions one at a time if they wanted it overturned. All the while knowing most of these people could 
not possibly afford that. If the ACLU had not fought this battle and won, that is exactly what would have happened. I 
wish everyone would think about how truly awful it is that it came very close to happening that way even though the 
evidence was found to be falsified.
      
        Whistleblowers in the lab tried to alert their supervisors for years about Annie because she always found 
positive results in 100% of her cases and she was claiming to be doing hundreds of tests each day. The supervisors lied 
and said she was being handled as a "personnel" issue. Enough defense lawyers complained about her that after many years 
she was finally interviewed by the state police and she immediately broke and confessed. That happened in 2012 yet the 
state department of Justice and local prosecutors fought for years against overturning all the convictions where she was 
involved. They wanted each individual to have to hire lawyers and appeal. The ACLU said it was the state's job to do that. 

Finally the State Supreme Court agreed and told the prosecutors to decide which cases they would continue to litigate. 
That's when the lying MFer's conceded that they were only confident in the righteousness of 1.5% of the 20,000 - 40,000
convictions in which Annie had been involved. She didn't do her b.s. just to look good to her bosses. She was on a 
mission to send as many men to prison for drugs as she could.
       
        If you were standing in a casino, and the roulette wheel always landed on a bar that didn't have any bets to pay, 
how long would it take to realize something was wrong? 4-5 hours? This went on for 12 years! The judges are paid to be 
sure the trials are fair. There is no way that even the guy cleaning the toilets in the courthouse didn't know exactly 
what was going on! In Washington DC there is a Department of Justice that is supposed to sneaking around doing random 
tests on these state labs. Well, we know that isn't happening. She got three yrs in prison and went free in 2016.
